Terms and conditions
Version 1 · effective from 2 November 2026
This is a translation. If the Dutch version and this translation differ, the Dutch version prevails.
These general terms and conditions apply to the Protection service that you take out on gtincodes.com. Please read them carefully; you can save or print them.
Article 1 – Definitions
In these terms and conditions:
- GTINcodes / we: means Eancodes V.O.F., trading under the name GTINcodes, established at Herengracht 320, 1016 CE Amsterdam, the Netherlands, Chamber of Commerce (KvK) no. 73198153, VAT no. NL859395893B01.
- Customer / you: means any natural person or legal entity that enters into or wishes to enter into an agreement with us.
- Consumer: means a customer who is a natural person and is not acting in the course of their profession or business.
- Business customer: means a customer acting in the course of their profession or business. A customer who provides a company name or VAT number when ordering or in their account is deemed to be a business customer.
- EAN code: means a 13-digit code (EAN-13 / GTIN-13) with a valid check digit, issued by us. An EAN code is not a GS1 membership and not a GS1 registration (Article 4).
- Protection / subscription: means the ongoing service described in Article 5, in the Basic, Premium or Business plan, on a monthly, annual or one-off (lifetime) basis.
- Period: means the term for which the subscription is paid in advance: one month or one year.
- Account: means the personal environment on gtincodes.com in which the customer manages their codes, subscription, payments and invoices.
- In writing: includes by e-mail or via the account.
- Collection agency: means Incassonet or any other collection agency or bailiff that we engage.
Article 2 – Identity and contact
- Eancodes V.O.F., trading under the name GTINcodes, Herengracht 320, 1016 CE Amsterdam, the Netherlands, Chamber of Commerce (KvK) no. 73198153, VAT no. NL859395893B01.
- Contactable via support@gtincodes.com, the contact form and the chat on gtincodes.com, and via the account.
Article 3 – Applicability
- These terms and conditions apply to every offer made by GTINcodes and every agreement concerning EAN codes and Protection that the customer enters into on gtincodes.com. EAN codes purchased from another of our shops are subject to the terms and conditions of that shop. If the customer takes out Protection for those codes on gtincodes.com, these terms and conditions apply to the Protection.
- Before the agreement is concluded, the customer can read and save these terms and conditions. They are available on gtincodes.com (link at the bottom of every page) and can be saved and printed. By taking out Protection, the customer accepts these terms and conditions.
- The customer's own terms and conditions do not apply.
- If any provision is null and void or is annulled, the other provisions remain in force. The provision will then be replaced by a valid provision that comes as close as possible to the original intent.
- For consumers, mandatory rules of consumer law always take precedence. Nothing in these terms and conditions derogates from them to the detriment of the consumer.
Article 4 – EAN codes: what they are and are not
- We are not a member of, not a partner of and not affiliated with GS1. Our EAN codes are not listed in the GS1 database, unless expressly stated otherwise.
- Some marketplaces and retailers require GS1 codes, for all products or per category. The customer must check before purchase what their sales channel requires. We are not liable if a sales channel refuses our codes or later changes its rules.
- An EAN code is a number and not property. We issue each code to one customer only. We cannot rule out that someone else uses the same number or that GS1 later assigns it to another party.
- Protection does not change anything in paragraphs 1 to 3 inclusive. It is a registration with GTINcodes, not a registration with GS1, and does not confer any exclusive right as against third parties.
Article 5 – The Protection service
- With Protection, we register the customer's EAN codes in their (business) name in our register. For as long as Protection is in effect:
- the public verification page on gtincodes.com displays, for each code, the name provided by the customer;
- the customer can download a registration certificate (PDF) bearing a number that anyone can verify online;
- we store the codes and the customer can download them at any time;
- the customer receives the additional features of their plan as stated on gtincodes.com at the time of taking out the subscription (such as product information per code, verification reports, multiple brands, API access and an objection letter for marketplaces).
- We use our best efforts to keep the service available at all times (obligation of means). Brief maintenance or an outage does not give rise to any right to a refund, unless the service is unavailable for more than 7 consecutive days.
- We do not guarantee that any marketplace, buyer or other party will accept the certificate or the verification page.
- The customer is responsible for the accuracy of the name and product information they enter. We may remove information that is incorrect or misleading, or that infringes the rights of others.
- After Protection ends, we no longer display the customer's name with their codes. The certificate then ceases to be valid. The codes remain the customer's to use.
Article 6 – Formation of the agreement and right of withdrawal
- The agreement is concluded as soon as the customer completes the order and pays. We confirm this immediately by e-mail.
- A consumer may withdraw from a distance contract within 14 days without giving any reason. This can be done by sending an e-mail to support@gtincodes.com or by using the model form at the bottom of this page. We confirm receipt immediately by e-mail.
- Protection: if the consumer withdraws within 14 days, we refund the amount paid within 14 days, using the same payment method. If the consumer expressly requested that the service start immediately, we retain the portion corresponding to the days that have already elapsed.
- EAN codes (digital content): the right of withdrawal lapses as soon as the codes have been delivered, if the consumer has given prior express consent to immediate delivery and has acknowledged that they thereby lose their right of withdrawal.
- Business customers have no right of withdrawal.
Article 7 – Term and renewal
- A monthly subscription runs per month and is automatically renewed for one month at a time.
- An annual subscription runs for one year. Thereafter it is automatically renewed:
- for a consumer, for an indefinite period, at the annual price payable yearly in advance, but always terminable on a monthly basis (Article 8(3));
- for a business customer, for one year at a time.
- On each renewal, the price of the new period is automatically debited via the payment method chosen by the customer (mandate). We notify the customer by e-mail of the renewal of an annual subscription no later than 30 days before the renewal.
- Lifetime: the customer pays once. Protection then runs for as long as GTINcodes offers the service, with a minimum of 10 years from payment. If we discontinue the service within 10 years, we refund pro rata for the remaining years up to those 10 years.
- A change of plan takes effect at the end of the current period, unless indicated otherwise in the account.
Article 8 – Termination
- The customer terminates in the account (Protection → Cancel protection) or via support@gtincodes.com. We confirm the termination immediately by e-mail.
- Termination takes effect at the end of the current period. Protection continues to work until that date. No further debits will be made. We do not refund the current period, unless required by law.
- A consumer whose annual subscription has been tacitly renewed may thereafter terminate at any time, subject to a notice period of one month. In that case we refund pro rata the prepaid portion relating to the time after that month.
- If a payment is still outstanding, the customer terminates via support@gtincodes.com. Termination remains possible in that case, but outstanding amounts remain due, including the interest and costs under Articles 11 and 12.
- Lifetime cannot be terminated with a refund, except within the withdrawal period (Article 6).
- We may terminate Protection with immediate effect if the customer misuses the service, enters false information or acts in breach of Article 5(4). We may also terminate a subscription subject to a notice period of 2 months. In that case we refund pro rata the prepaid portion relating to the time after termination.
Article 9 – Prices and price changes
- Prices are shown on gtincodes.com and in the checkout, both excluding and including VAT. For business customers in another EU member state with a valid VAT number, VAT is reverse-charged.
- The price applies to the current period and to renewals until we announce a change.
- We notify any price increase by e-mail at least 30 days before it takes effect. The customer may then terminate free of charge with effect from the date on which the new price takes effect. An increase within the first 3 months after taking out the subscription is only possible if it results from the law, such as a change in VAT.
- Obvious errors in a price are not binding on us.
Article 10 – Payment
- The customer pays for the first period (or lifetime) immediately upon taking out the subscription, via Mollie or PayPal. Protection starts as soon as that payment has been received.
- With the first payment, the customer grants a mandate to automatically debit subsequent periods. Payment is due on the first day of each new period. That day is also the final payment date.
- The customer ensures that there is sufficient balance or credit available on the debit date. The customer keeps their payment details up to date and can change them in the account.
- A refused, failed or reversed payment (reversal or chargeback) is deemed not to have been paid. We will retry the debit up to 3 times in the following days, and the customer can always pay the amount directly in the account.
- If payment is not successful, we may suspend Protection until everything has been paid: the name is then not displayed with the codes, the certificate is not valid and downloading is temporarily unavailable. The payment obligation for the current period remains in force.
- We send invoices electronically, in the account and by e-mail. The customer must report any complaints about an invoice within 14 days. This does not suspend the payment obligation.
Article 11 – Default and interest
- Business customer: if the business customer does not pay on the payment date referred to in Article 10(2), they are in default without any notice of default being required. From that day, they owe the statutory commercial interest (Article 6:119a of the Dutch Civil Code (BW)) on the outstanding amount.
- Consumer: if the consumer does not pay on the payment date, we first send a payment reminder free of charge, granting a period of at least 14 days after receipt to pay after all (Article 12(2)). If the consumer also fails to pay within that period, they are in default from the end of that period and owe the statutory interest (Article 6:119 of the Dutch Civil Code (BW)).
- If the default lasts longer than one year, the interest is added to the principal sum at the end of each year, as permitted by law.
- Payments by the customer are applied first to the costs, then to the interest and then to the oldest outstanding principal sum.
Article 12 – Collection costs and collection agency
- If the customer does not pay after a reminder, we may hand over the claim to Incassonet or another collection agency or a bailiff. For that purpose, we provide that agency with the name, address and contact details, company details, invoice and payment details and the correspondence relating to the claim. That agency may collect the claim on our behalf.
- Consumer: extrajudicial collection costs are only due after we have sent a demand for payment stating: the outstanding amount, the period of 14 days after receipt to pay free of charge, and the amount of the costs that will be charged if the consumer does not pay on time (Article 6:96(6) of the Dutch Civil Code (BW)). The costs are then capped at the amount set out in the Decree on Compensation for Extrajudicial Collection Costs (Besluit vergoeding voor buitengerechtelijke incassokosten) (currently 15% of the first € 2,500, with a minimum of € 40, and lower percentages above that).
- Business customer: if the business customer is in default, they owe the extrajudicial collection costs in accordance with the scale set out in the decree referred to in paragraph 2, with a minimum of € 40 per invoice. If we demonstrably incur higher costs, the business customer owes those costs in full.
- If legal proceedings are brought and the customer is found to be (partly) in the wrong, the customer also pays the legal costs and the post-judgment costs in accordance with the law.
- Instead of outsourcing, we may also collect the claim ourselves. Paragraphs 2 and 3 then apply in the same way.
- We may offer a payment arrangement. If it is not complied with, the entire remaining balance becomes immediately due and payable, including interest and costs.
Article 13 – Liability
- We are not liable for damage resulting from: the choice of a sales channel or its rules, the refusal or removal of listings, the blocking of a seller account, changes in the policies of GS1 or marketplaces, or the use of the same number by another party (Article 4).
- If we are nevertheless liable, we are liable only for direct damage, up to a maximum of the amount the customer paid for Protection in the 12 months preceding the event that caused the damage (for lifetime: the one-off amount paid). We do not compensate indirect damage, such as loss of profit, loss of revenue and business interruption.
- These limitations do not apply in the event of intent or deliberate recklessness on the part of us or our managerial staff.
- For consumers, these limitations apply only to the extent permitted by law.
- A claim against us lapses if the customer does not notify us of it in writing within one year after discovering the damage. For consumers, the statutory time limits apply.
Article 14 – Force majeure
- In the event of force majeure, we are not required to perform our obligations for as long as it lasts. Force majeure includes, among other things: outages at hosting, payment or e-mail services, cyberattacks, and changes at marketplaces or GS1 over which we have no control.
- If the force majeure lasts longer than 60 days, either party may terminate the subscription. We refund the prepaid portion pro rata.
Article 15 – Complaints
- The customer must report complaints as soon as possible after discovery, with a clear description, via support@gtincodes.com or the account.
- We respond within 14 days. If we need more time, we will let the customer know within 14 days when they will receive a response.
- A complaint does not suspend the payment obligation, except for the portion to which the complaint relates and to the extent the law so provides for consumers.
- If we cannot resolve the matter together, a consumer may refer it to the competent court (Article 18).
Article 16 – Privacy
- We process personal data in accordance with our privacy policy.
- In order to collect outstanding payments, we provide the data referred to in Article 12(1) to the collection agency. We do so on the basis of our legitimate interest in receiving payment, and the agency uses the data solely for the collection.
- We publicly display the name that the customer provides for Protection with their codes (Article 5). The customer can change this in their account.
Article 17 – Amendment of these terms and conditions
- We may amend these terms and conditions. We notify any amendment by e-mail, together with the new text, at least 30 days before it takes effect.
- If an amendment is disadvantageous to the customer, the customer may terminate the subscription free of charge with effect from the date on which the amendment takes effect. If the customer does not terminate, the new version applies from that date.
- An amendment that is solely advantageous or is required by law may take effect immediately.
- Amounts outstanding from before an amendment remain due under the terms and conditions that applied at that time, supplemented by what the law provides.
Article 18 – Governing law and competent court
- All agreements are governed by Dutch law. The Vienna Sales Convention (CISG) does not apply.
- Disputes with business customers are submitted to the Rechtbank Amsterdam (Amsterdam District Court), unless the subdistrict court (kantonrechter) has jurisdiction.
- A consumer retains the protection of the mandatory rules of the country in which they reside, and may also bring proceedings before the court of their place of residence.
